1. Introduction

Welcome to GlowUp, a mobile app operated by TMBC Pte Ltd ("we", "us", or "our"). By using GlowUp, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with these Terms, please do not use the app.

2. Not Medical Advice

GlowUp provides AI-generated skincare insights for informational and educational purposes only.

It does not constitute medical advice, diagnosis, or treatment. For any medical concerns, please consult a licensed dermatologist or healthcare professional.

3. Eligibility

This app is intended for use by individuals 18 years and older. By using the app, you confirm that you are at least 18 years of age.

4. Use of the App

You may use the app without creating an account. Some features are available only to premium users through in-app purchases.

You agree not to:

  • Use the app for unlawful purposes
  • Attempt to reverse-engineer or exploit any part of the app
  • Misuse or interfere with the app's functionality

5. In-App Purchases

GlowUp offers both free features and premium features. All purchases are handled through Apple App Store or Google Play Store.

We do not offer refunds for in-app purchases, except as required by the platform's refund policy.

6. Content Ownership

All content, branding, and design in the app are owned by TMBC Pte Ltd and protected under intellectual property laws. You may not copy, modify, or distribute any part of the app without permission.

7. Third-Party Services

We use third-party services including:

  • OpenAI (to process face scans)
  • RevenueCat (to manage in-app purchases)

By using GlowUp, you acknowledge and agree to their terms and privacy policies as well.

9. Account & Data Deletion

If you wish to delete your data, you can do so directly within the app.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of the app after changes means you accept the updated Terms.

12. Limitation of Liability

By using this app, you agree that TMBC Pte Ltd, its officers, directors, employees, and affiliates will not be held liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to:

  • Skin irritation, breakouts, allergic reactions, or any physical, medical, or emotional effects arising from the use of the app or its recommendations
  • Damage resulting from reliance on any information provided by the app or its AI assistant
  • Loss of data, revenue, profits, goodwill, or other intangible losses
  • Any issues caused by third-party services (e.g. OpenAI, RevenueCat, Apple/Google)

You use the GlowUp app at your own risk. The app provides informational insights only and does not replace professional medical or dermatological advice.

13. No Warranty

GlowUp is provided on an "as is" and "as available" basis. We make no warranties, expressed or implied, regarding the accuracy, reliability, or suitability of the app for your personal needs. We do not guarantee any specific skincare results.

14. Indemnification

You agree to indemnify and hold harmless TMBC Pte Ltd and its affiliates from any claims, demands, liabilities, losses, or expenses — including legal fees — arising out of:

  • Your use of the app
  • Your violation of these Terms
  • Your reliance on any insights or recommendations provided by the app

15. Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of Singapore. Any disputes shall be subject to the exclusive jurisdiction of the courts of Singapore.
